Native Title & Cultural Heritage (CHMP)

    Get Started with This Skill

    Overview

Draft and validate Cultural Heritage Management Plans for Australian land development under Aboriginal Heritage Act 2006 (VIC) and Aboriginal Cultural Heritage Act 2021 (WA). Covers engagement order, CHMP structure, and state-mandated Unexpected Finds Protocol. For property development and mining.

    Example conversation

You: We’re drafting a CHMP for a residential subdivision in Victoria. I’ve got our engagement records with the RAP in the project. Can you draft the Unexpected Finds Protocol and then check it against the Act?

Agent: I’ll add an Unexpected Finds Protocol that requires stopping work on any find, reporting to First Peoples - State Relations (Preliminary Report), and for suspected human remains contact Victoria Police and the Coroner (1300 888 544). I’ll use the skill’s state-specific wording. Then I’ll run contingency_clause_audit on the CHMP with state “vic” to confirm it’s compliant.

    Excerpt of a generated document

The following is an excerpt from an Unexpected Finds Protocol the agent might produce for a Victorian CHMP (the contingency_clause_audit tool would confirm stop work, reporting, and human-remains wording are present):

    ## 7. Unexpected Finds Protocol

If Aboriginal cultural heritage (a place or object) is discovered during works:

    1. **Stop work** — Cease all activity in the immediate area of the find. Secure the area to prevent further disturbance and protect the find.
    2. **Report** — Notify First Peoples - State Relations without delay. Submit a Preliminary Report as required under the Aboriginal Heritage Act 2006 (Vic). Do not remove or disturb the find.
    3. **Human remains** — If suspected human remains are found and are reasonably believed to be Aboriginal, contact Victoria Police and the Coroner's Court immediately (1300 888 544). Do not disturb the area.

Works in the find area shall not resume until direction is received from First Peoples - State Relations or the relevant authority.
